This document primarily represents the transaction entered between the two parties. The provisions regarding the Tax Invoice is given in the Section 31 of the CGST (Amendment) Act and Rule 46 to 55A of the CGST Rules (Amendment) 2017. The CGST Act prescribes certain prescribed disclosures which are to be mentioned in every tax invoice issued by the registered dealer under the Act. <\/p>\n\n\n\n<h2 class=\"has-text-align-center wp-block-heading\"><span class=\"ez-toc-section\" id=\"PROVISIONS_REGARDING_TAX_INVOICE\"><\/span><strong>PROVISIONS REGARDING TAX INVOICE<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-87-1.png\" alt=\"\" class=\"wp-image-4126\"\/><\/figure>\n\n\n\n<p class=\"has-background has-green-background-color\"><strong>TIME OF ISSUE OF TAX INVOICE IN CASE\nSUPPLY OF GOODS<\/strong><\/p>\n\n\n\n<p><strong>Where the <a href=\"https:\/\/commerceiets.com\/taxable-supply\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"supply (opens in a new tab)\">supply<\/a> involves the movement of goods:<\/strong> The tax invoice is prepared before or at the time of removal of the goods.<\/p>\n\n\n\n<p><strong>In any other case:<\/strong> At the time of delivery of goods or making\navailable thereof to the recipient.<\/p>\n\n\n\n<p>If the supply is in continuous nature than successive statements\nof accounts will be issued.<\/p>\n\n\n\n<p>In case of sale on approval basis when the recipient approves\nthe goods or 6 months from the date of removal, invoice will be issued.<\/p>\n\n\n\n<p>Provided further government many on the recommendation of GST\ncouncil, provide the time and manner of issue of the invoice for certain\ncategories of goods and supplies.<\/p>\n\n\n\n<p class=\"has-background has-green-background-color\"><strong>TIME OF ISSUE OF INVOICE IN CASE OF SALE OF SERVICE<\/strong><\/p>\n\n\n\n<p>The time of\nissue of invoice is within 30 days from the date of provision of the service.<\/p>\n\n\n\n<p>If the\nsupply is in continuous nature and <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The due\ndate is ascertainable then invoice will be issued on or before the due date of\nthe payment.<\/li><li>The due\ndate is not ascertainable then invoice will be issued on or before the date of\npayment.<\/li><li>The payment is linked to completion of an event then invoice\nwill be issued on or before the completion of the event.<\/li><\/ul>\n\n\n\n<p>If the supplier is a bank or insurance company or any financial\ninstitution then within 45 days from the date of supply of service invoice will\nbe issued.<\/p>\n\n\n\n<p>In a case where the supply of services ceases under a contract\nbefore the completion of a supply, the invoice shall be issued at the time when\nthe supply eases and such invoice shall be issued to the extent of the supply\nmade before such cessation.<\/p>\n\n\n\n<p>Some other provisions regarding tax invoice in case of supply of\ngoods and services is as follows: <\/p>\n\n\n\n<p>(1) If the value of the supply is less than the Rs. 200\/-and the\nrecipient is unregistered and also does not require such invoice than no need\nto issue a tax invoice instead one aggregate invoice for each day be issued.\nThe same provision is also applied in case of Bill of Supply.<\/p>\n\n\n\n<p>(2) In case of advance payment\u2013 The receipt voucher will be\nissued and subsequently no supply is made than no tax invoice is required to be\nissued.<\/p>\n\n\n\n<p>(3) In case of registered person liable to pay the tax under\nreverse charge basis from an unregistered supplier, shall issue an invoice on\nthe date of receipt of goods and services. Further he has to issue payment\nvoucher at the time of making payment to the supplier.<\/p>\n\n\n\n<p>(4) As per the&nbsp;<strong>notification no. 45\/2017 Central\nTax dated 13<sup>th<\/sup>&nbsp;October 2017<\/strong>&nbsp;\u201cIf a registered person is\nsupplying taxable as well as exempted to an unregistered person then he can\nissue a single \u201cinvoice-cum-bill of supply\u201d for all such supplies.<\/p>\n\n\n\n<p>(5) Now due to the 14<sup>th<\/sup>&nbsp;Amendment to the&nbsp;<strong>CGST Rules<\/strong>&nbsp;there is no\nrequirement of signature \/digital signature of the supplier or his authorized\nrepresentative in case of tax invoice is issued electronically. However it may\nbe noted here that the all such tax invoice must be issued in accordance with\nthe provisions of the Information Technology Act, 2000.<\/p>\n\n\n\n<p class=\"has-background has-green-background-color\"><strong>INFORMATION TO BE PROVIDED IN TAX\nINVOICE<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"\"><tbody><tr><td>\n  <strong>Sr.\n  No.<\/strong>\n  <\/td><td>\n  <strong>Information\n  to be provided<\/strong>\n  <\/td><\/tr><tr><td>\n  <strong>1.<\/strong>\n  <\/td><td>\n  Type\n  of Invoice\n  <\/td><\/tr><tr><td>\n  <strong>2.<\/strong>\n  <\/td><td>\n  Invoice\n  number and date\n  <\/td><\/tr><tr><td>\n  <strong>3.<\/strong>\n  <\/td><td>\n  Name,\n  Shipping and billing address, Customer and taxpayer\u2019s GSTIN (if registered)\n  <\/td><\/tr><tr><td>\n  <strong>4.<\/strong>\n  <\/td><td>\n  Place\n  of supply along with name of the State , in case of a supply in the course of\n  interstate trade or commerce.\n  <\/td><\/tr><tr><td>\n  <strong>5.<\/strong>\n  <\/td><td>\n  HSN\/\n  SAC code, wherever applicable.\n  <\/td><\/tr><tr><td>\n  <strong>6.<\/strong>\n  <\/td><td>\n  Description\n  of Item in details i.e. description, unique quantity code ,quantity, total\n  value etc.\n  <\/td><\/tr><tr><td>\n  <strong>7.<\/strong>\n  <\/td><td>\n  Total\n  Value , Taxable value and discounts given on supply\n  <\/td><\/tr><tr><td>\n  <strong>8.<\/strong>\n  <\/td><td>\n  Rate\n  of Tax (CGST,SGST\/ UTGST , Cess and IGST).\n  <\/td><\/tr><tr><td>\n  <strong>9.<\/strong>\n  <\/td><td>\n  Whether\n  tax is payable on reverse charge basis.\n  <\/td><\/tr><tr><td>\n  <strong>10.<\/strong>\n  <\/td><td>\n  Place\n  of the delivery where the same is different from the supply.\n  <\/td><\/tr><tr><td>\n  <strong>11.<\/strong>\n  <\/td><td>\n  Signature\n  of the supplier\/authorized representative\n  <\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>If the recipient is not registered AND the value is more than\nRs. 50,000 then the invoice should carry:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Name and address of the recipient,<\/li><li>Address of delivery,<\/li><li>State name and state code<\/li><\/ul>\n\n\n\n<p>Further when the Tax invoice issued in case of export of goods \/\nservices it shall carry an endorsement that \u201c Supply meant for export on\npayment of IGST\u201d or \u201csupply meant for export under bond or letter of\nundertaking without payment of IGST\u201d, as the case may be. It shall also contain\ninformation&nbsp;<strong>:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Name and address of the recipient .<\/li><li>Address of the delivery.&nbsp;<\/li><li>Name of the country of the destination<\/li><\/ol>\n\n\n\n<p class=\"has-background has-green-background-color\"><strong>TAX INVOICE IN SPECIAL CASES (RULE 54 OF THE CGST RULES):<\/strong><\/p>\n\n\n\n<p><strong>CASE 1:<\/strong> When the tax invoice is\nissued by the banking company \/NBFC\/Financial institution than invoice serial\nno. and the address of the recipient is not necessary.<\/p>\n\n\n\n<p><strong>CASE 2:<\/strong> When the tax invoice is\nissued by the supplier of the passenger transport service than address of the\nrecipient is not necessary.<\/p>\n\n\n\n<p><strong>CASE 3:<\/strong> When the tax invoice is\nissued by a Goods transport agency then invoice should have the following\nadditional information:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Gross weight of the consignment .<\/li><li>Name of the consignor &amp; the consignee .<\/li><li>Registered no. of the goods carriage , used for transportation.<\/li><li>Details of the goods transported.<\/li><li>Details of the place of the origin &amp; destination.<\/li><li>GSTIN of person liable for paying tax.<\/li><\/ul>\n\n\n\n<p><strong>CASE 4:<\/strong> When the tax invoice is\nissued by the Input Service Distributor (ISD) then it shall contain the\nfollowing mentioned information:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Name , address and GSTIN of the ISD .<\/li><li>A consecutive serial no. as prescribed .<\/li><li>Date of issue<\/li><li>Name , address and GSTIN of the recipient to whom the credit is\ndistributed<\/li><li>Amount of the credit distributed<\/li><li>Signature of the ISD or authorized representative .<\/li><\/ul>\n\n\n\n<p><strong>CASE 5:<\/strong> When the tax invoice is\nissued by a registered person having the same PAN and the state code as the ISD\n, to transfer the credit of common input services to the ISD then it shall\ncontain the following mentioned details :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Name , address and GSTIN of the registered person having the\nsame PAN as the ISD .<\/li><li>A consecutive serial no. as prescribed .<\/li><li>Date of issue<\/li><li>Name , address and GSTIN of the ISD<\/li><li>GSTIN of the supplier of common services and the original\ninvoice no. whose credit is sought to be transferred to the ISD.<\/li><li>Taxable value , rate and the amount of the credit to be\ntransferred .<\/li><li>Signature of the ISD or authorized representative<\/li><\/ul>\n\n\n\n<p class=\"has-background has-green-background-color\"><strong>MANNER OF ISSUING THE TAX INVOICE {RULE 48 OF THE CGST RULES (AS\nAMENDED) 2017}<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"596\" height=\"217\" src=\"https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-88.png\" alt=\"\" class=\"wp-image-4127\" srcset=\"https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-88.png 596w, https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-88-300x109.png 300w\" sizes=\"auto, (max-width: 596px) 100vw, 596px\" \/><\/figure>\n\n\n\n<p><a href=\"https:\/\/taxguru.in\/wp-content\/uploads\/2019\/03\/Manner-of-Issuing-the-Tax-Invoice-Rule-48-of-the-CGST-Rules-As-amended-2017.png\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\n\n\n\n<p><strong>Bill of supply<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"604\" height=\"130\" src=\"https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-89.png\" alt=\"\" class=\"wp-image-4128\" srcset=\"https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-89.png 604w, https:\/\/commerceiets.com\/wp-content\/uploads\/2020\/03\/image-89-300x65.png 300w\" sizes=\"auto, (max-width: 604px) 100vw, 604px\" \/><\/figure>\n\n\n\n<p><a href=\"https:\/\/taxguru.in\/wp-content\/uploads\/2019\/03\/Bill-of-Supply.png\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\n\n\n\n<p>Now due to the 14<sup>th<\/sup>\u00a0Amendment to the CGST Rules there is no requirement of signature \/digital signature of the supplier or his authorized representative in case of bill of supply is issued electronically.
