So force or threats are used to obtain the consent of the party under <a href=\"https:\/\/commerceiets.com\/coercion\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"coercion (opens in a new tab)\">coercion<\/a>, i.e it is not free consent. <\/p>\n\n\n\n<p><strong>ACCORDING TO SECTION 15\nOF INDIAN CONTRACT ACT, 1872<\/strong><\/p>\n\n\n\n<p>\u201cCoercion is<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>committing or threatening to commit any act forbidden by the law in\nthe&nbsp;IPC<\/li><li>unlawfully detaining or threatening to detain any property with the\nintention of causing any person to enter into a contract.\u201d<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"UNDUE_INFLUENCE\"><\/span><strong>UNDUE\nINFLUENCE<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nterm &#8216;undue influence&#8217; means the improper or unfair use of one&#8217;s superior power\nin order to obtain the consent of a person who is in a weaker position.<\/p>\n\n\n\n<p><strong>ACCORDING TO SECTION 16\nOF INDIAN CONTRACT ACT 1872<\/strong><\/p>\n\n\n\n<p>\u201cWhen the relations between the two parties are such\nthat one party is in a position to dominate the other party, and uses such\ninfluence to obtain an unfair advantage of the other party it will be undue\ninfluence.\u201d<\/p>\n\n\n\n<p>The section also further describes how the person can\nabuse his&nbsp;authority&nbsp;in\nthe following two ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>When a person holds real or even apparent authority over the other\nperson. Or if he is in a fiduciary&nbsp;relationship&nbsp;with\nthe other person.<\/li><li>He makes a contract with a person whose mental capacity is affected by\nage, illness or distress. The unsoundness of mind can be temporary or permanent.<\/li><\/ul>\n\n\n\n<p>EXAMPLE: A sold his gold watch for only Rs 500\/- to his teacher B after his teacher promised him good grades. Here the consent of A is not freely given; he was under the <a href=\"https:\/\/commerceiets.com\/undue-influence\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"influence (opens in a new tab)\">influence<\/a> of his teacher.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><span class=\"ez-toc-section\" id=\"COERCION_VS_UNDUE_INFLUENCE-2\"><\/span><strong>COERCION VS UNDUE INFLUENCE<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"\"><tbody><tr><td>\n  <strong>BASIS FOR COMPARISON<\/strong>\n  <\/td><td>\n  <strong>COERCION<\/strong>\n  <\/td><td>\n  <strong>UNDUE INFLUENCE<\/strong>\n  <\/td><\/tr><tr><td>\n  <strong>MEANING<\/strong>\n  <\/td><td>\n  Coercion is an act of\n  threatening which involves the use of physical force.\n  <\/td><td>\n  Undue Influence is an act of\n  influencing the will of the other party.\n  <\/td><\/tr><tr><td>\n  <strong>SECTIONS<\/strong>\n  <\/td><td>\n  It is governed by Section 15\n  of the Indian Contract Act, 1872.\n  <\/td><td>\n  It is governed by Section 16\n  of the Indian Contract Act, 1872.\n  <\/td><\/tr><tr><td>\n  <strong>USE OF<\/strong>\n  <\/td><td>\n  It involves the use of Psychological\n  pressure or Physical force.\n  <\/td><td>\n  It involves the use of Mental\n  pressure or Moral force.\n  <\/td><\/tr><tr><td>\n  <strong>PURPOSE<\/strong>\n  <\/td><td>\n  Its purpose is to compel a\n  person in such a way that he enters into a contract with the other party.\n  <\/td><td>\n  Its purpose is to take unfair\n  advantage of his position.\n  <\/td><\/tr><tr><td>\n  <strong>CRIMINAL NATURE<\/strong>\n  <\/td><td>\n  Coercion\n  is of criminal nature.\n  <\/td><td>\n  Undue influence is not of\n  criminal nature.\n  <\/td><\/tr><tr><td>\n  <strong>RELATIONSHIP<\/strong>\n  <\/td><td>\n  The relationship between parties\n  is not necessary.\n  <\/td><td>\n  The act of undue influence is\n  done only when the parties to the contract are in relationship. Like teacher\n  &#8211; student, doctor &#8211; patient etc.\n  <\/td><\/tr><tr><td>\n  <strong>CARRIED BY<\/strong>\n  <\/td><td>\n  Coercion is directly carried by the party or sometimes by\n  strangers also.\n  <\/td><td>\n  Undue Influence is carried by the party who is superior to the\n  other party or by the stronger party to get weaker party consent.\n  <\/td><\/tr><tr><td>\n  <strong>AGREEMENT<\/strong>\n  <\/td><td>\n  If consent to an agreement is caused by coercion, the\n  agreement becomes voidable at the option of the party whose consent was so\n  caused.\n  <\/td><td>\n  If consent to an agreement is caused by undue influence, the\n  agreement becomes voidable at the option of the party whose consent was so\n  caused.\n  <\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><span class=\"ez-toc-section\" id=\"CONCLUSION\"><\/span><strong>CONCLUSION<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Coercion and Undue Influence both are barriers in the path of free consent of the parties which is an essential element of a contract.
